Please read these Terms and Conditions carefully before engaging our services or placing any order.
By instructing Bear Media to carry out work, you confirm that you have read, understood,
and agree to be bound by these Terms and Conditions.
1. About Us
Bear Media is a digital marketing, web design, and print agency based in Plymouth,
serving businesses across the South West of England, including Devon and Cornwall.
Services Provided
Website design and development, search engine optimisation (SEO), Google Ads management,
social media marketing, leaflet design, print and distribution, branding,
and related digital and print services.
2. Definitions
Client / You
The individual, business, or organisation engaging Bear Media for services.
Services
Any work carried out by Bear Media as agreed between the parties.
Project
A specific piece of work such as a website build, print run, or marketing package.
Agreement
The instruction, order confirmation, or written acceptance between the Client and Bear Media.
3. Engaging Our Services
Agreement Formation
An agreement is formed when a Client instructs Bear Media to proceed with a project,
whether verbally, by email, via intake form, or by payment.
Right to Decline
Bear Media reserves the right to decline any instruction at its discretion.
4. Payment Terms
Website Design and Development
50% deposit required before work begins.
Remaining 50% due before go-live or handover.
No files or credentials transferred until full payment is received.
Other Services
Full payment required upfront before work or materials are ordered.
Marketing Packages
Monthly fees are due in advance and operate on a rolling monthly basis.
Google Ads Management
20% management fee capped at £250 per month.
First 3 months free for new clients.
Late Payment
Invoices due on receipt unless otherwise agreed.
Services may be paused after 14 days overdue.
5. Leaflet Campaign Packages
Discounted Campaign Terms
Multi-month campaigns receive discounted pricing.
Early cancellation requires repayment of all discounts applied.
6. Cancellations and Refunds
Website Deposits
Non-refundable once work has commenced.
Print and Leaflet Orders
No cancellations after printing or scheduling.
Monthly Packages
Can be cancelled before next billing cycle.
7. Website File Transfer
Transfer Fee
Website file transfer and administration fee is £60.
Ownership
Ownership transfers only after full payment.
8. Client Responsibilities
Client Obligations
Provide accurate information and required materials promptly.
Review and approve work within agreed timelines.
Ensure all supplied materials are properly licensed.
9. Revisions and Amendments
Included Revisions
Reasonable revisions included in website projects.
Additional Work
Changes outside agreed scope are charged separately.
10. Leaflet Distribution
Tracking and Quality Assurance
GPS tracking available upon request.
Quality assurance checks carried out on approximately 70% of properties.
Minimum Order
Minimum order is 5,000 leaflets per distribution run.
11. SEO and Digital Marketing
No Guarantees
No guarantees on rankings, traffic, or business outcomes.
12. Intellectual Property
Ownership Rights
All work remains property of Bear Media until paid in full.
Portfolio Usage
Completed work may be displayed in Bear Media portfolio unless requested otherwise.
13. Confidentiality
Both parties agree to keep confidential business information private.
14. Data Protection and GDPR
Personal data processed in accordance with UK GDPR and Data Protection Act 2018.
15. Limitation of Liability
Liability limited to fees paid for the relevant project or service.
16. Complaints
Complaints acknowledged within 2 working days and resolved where possible within 10 working days.
17. Force Majeure
No liability for delays caused by circumstances outside reasonable control.
18. Amendments
Terms may be updated at any time. Continued use indicates acceptance.
19. Governing Law
These Terms are governed by the laws of England and Wales.
